SUNGUARD LIMITED is a New Zealand trader and sells these products in trade.
Orders and acceptance
Submitting an order does not require us to accept it. We may review dimensions, product selections, availability, delivery requirements and pricing before confirming acceptance. If we cannot accept an order, any payment received for that order will be refunded.
Pricing and payment
Payments are processed securely by Stripe. The Outdoor Shade Factory does not store full card details on this website.
Website prices are in New Zealand dollars and include GST unless stated otherwise. The price applying to an order is the price shown when the order is submitted, subject to correction of obvious pricing or technical errors before the order is accepted.
Custom-made products and measurements
Many products are manufactured specifically to the dimensions and options you provide. You are responsible for checking measurements, mounting type, control side, colour, material and other selections before submitting the order. A product manufactured correctly to incorrect customer-supplied measurements or selections is not considered faulty.
Changes and cancellations
Please contact us immediately if you need to change or cancel an order. Once a custom-made product has entered production, changes or cancellations may not be possible. If we agree to a cancellation after work or purchasing has commenced, reasonable non-recoverable costs already incurred may be deducted to the extent permitted by law.
Change of mind
Custom-made products are not returnable or exchangeable for change of mind, incorrect measurements, incorrect selections or other non-fault reasons. This does not limit rights you may have under the Consumer Guarantees Act 1993 or other applicable New Zealand law.
Product information and colour
We aim to describe products accurately, but photographs, screen settings, lighting and manufacturing batches can affect appearance. Where colour matching is important, we recommend viewing a physical sample before ordering.
Delivery
Estimated manufacturing and delivery periods are estimates rather than guaranteed delivery dates. Rural, remote or oversized deliveries may require an alternate delivery address, depot collection or an additional freight arrangement. Risk of loss or damage passes when the goods are delivered to the nominated delivery location, subject to any rights available under New Zealand law.
Inspection on delivery
Please inspect packaging and goods promptly after delivery. Notify us of visible freight damage, shortages or incorrect items as soon as possible and, where practical, within 7 days. Photographs of the packaging and affected product may be required for a freight or warranty assessment. This notification request does not limit statutory rights.
Installation
DIY products must be installed to suitable structure using appropriate fixings and the supplied installation information. Fixed electrical work must be completed by an appropriately qualified person. Damage or poor operation caused by incorrect installation is not a product defect.
Warranty and consumer rights
Product-specific warranty periods and exclusions are set out on the Warranty page. Nothing in these terms is intended to exclude, restrict or modify rights that cannot legally be excluded under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand law.
